This note from Marj slates final vote on the Sat Bch red light camera issue for Feb 2nd, that's this Wednesday night, so we have very little time to get the word out to encourage all Satellite Beach residents to voice their objections to the SB City Council.  I'm pretty sure that, absent a lot of opposition from the residents, the measure will carry on a 4 - 1 vote, or, best case 5 - 2 if Mayor Ferrante sides with Scott Rhodes, the only reliable conservative on the board.  Please folks, let's try to get the word out and try to defeat this money-grabbing measure that deprives us of our Constitutional right to due process (the right to a defendant "to be confronted by the witnesses against him" as guaranteed by the 6th Amendment).  Since (at least to the best of my knowledge) there's been no rash of accidents due to existing police procedures being inadequate to enforce our traffic signal laws, we can only conclude that this plan is being considered purely as a revenue generating measure and has nothing to due with traffic safety.  The fact that, on the council meeting's agenda, the issue is listed under "Miscellaneous New Revenue Sources" serves to reinforce my conclusion.  If you're unable to attend the meeting (they schedule most of them on Wednesday nights when a lot of us have church), at least send an email or call SB City Hall (773-4407) and leave a message expressing your opposition - a few calls won't make much difference, but a lot of them will.  God Bless, Skip B. 

This old issue is raising its ugly head in my little town of Satellite Beach!  As we had not been paying much attention to local politics, we didn't even realize it was being considered.  Apparently, it's coming up for a final vote of approval at this week's meeting--Feb. 2!

Thank you so much for your voice!  It is very important that the people have media, like you, to not only inform us of what is actually going on in the world around us but to stimulate thought and open debate.

We need to hear and talk about the good, bad and ugly in order to realize and acknowledge that each of us really does have an effect on what happens around us and on each other.

In my opinion:

Our forefathers designed the Constitution, Declaration of Independence and Bill of Rights to protect us from tyranny and evil. They did so with an enormous amount of blind faith and confidence in us, a generation that they could not have possibly foreseen, trusting that we would use these documents to protect man's rights, to be brave, to be strong, to be problem solvers, to be compassionate, to help those in time of need and that we would inspire and encourage others to do the same.

Thank you for your response.  It is true, I usually hear much less than half of what you say because of the the many things I do at that time of day.  As a result, I try not to respond to the day part that I do hear because - I have less than half the story...  Thanks for setting me straight.

On the other hand, I really enjoyed your segment with Rich Workman today.  It goes down as one of the best I have heard - as long as Rich does what he says - and I think he will!  One thing that really touched me today was the impact that citizens are making here locally.  Not only is Rich Workman paying attention to us, the conservatives, people Like Penny Canalas and Scott have taken action and are doing the things necessary to get real change to occur at the local level!

May I recommend that you have a segment with them on air (either together or seperately) to discuss and honor their efforts to focus in on a course of action and the fight they had to get to this point and what the next steps in front of them are.  I think they are local heros and I am proud to know them.

have portable signal senders that can be moved all over the place.

I was disappointed by your comments in your program today.  Your position that we should give Obaman a chance and that instead of attacking him we should focus on the victory we made in the past election is falling for the Democrat trap!  The article below underscores Obama's desire to mislead us, make us feel good and trust him as he continues to move his socialist agenda forward at a rapid pace.  Obama didn't talk about the massive redistribution of wealth agenda that we are now going through as a Nation because the people do not want this, he knew it would not be popular.  Obama's agenda must be stopped!  We must be visible, active and united if we want to get our country back.  You play an important role in motivating us and keeping us focused.

We need to build on the momentum from the election in November.  We need to be more active and united, not passive and waiting to be led by a man whose agenda has nothing to do with a strong United States of America.

What subsidies do we give oil companies?

The government gives and takes away so it is always hard to figure. The common sense way is to look at is the net cash flow.  America oil companies are granted tax breaks, much like any other business, but if we look at the net you get a better picture. ExxonMobil usually pays about twice its profit in taxes every year. When Exxon made $17B dollars in profit they paid $34B in taxes. Compare that with other companies in the US and companies including oil in foreign countries and it obvious the oil companies are paying more than a fair amount. That is one reason we are getting more dependent on foreign oil and more and more jobs are leaving this country. Do not be fooled by disingenuous rhetoric of the President Obama. The bottom line with Obama is every idea is being twisted to increase government control, increase taxes, and redistribute the wealth to fit his socialist agenda.

Increasing the costs to oil companies is just part of Obama’s plan to get to $5 a gallon gasoline.

As I listened to the State of the Union address, I wondered how we are going to achieve anything. Our trac record is not so good.  In 1973 we had an Arab oil embargo. Gas prices doubled. Prices of other consumer items rose because oil is used in so many different things in our life.  We have committed to become oil independent. It is now 2011 and where do we stand. We are still as much oil independent as ever.  Gas prices are are over three dollars a gallon and will probably hit four dollars by this summer. This will have a profound effect on the middle class. Instead of money they could be using for entertainment, clothing, food and other necessities, it will be going into the gas tank.

It has not been until recently that we have moved forward in our energy needs. Each party blames each other for everything wrong. I wish for once congress will do something. We cannot wait 35 years to take the tiger by its tail. We need to make hard decisions today. If we can't do that now, tomorrow will be unbearable.

Because of Penny Canales's dedication to the principals of Constitutional liberties and freedom for all, and her tenasity in fighting for the rights of those she does not even know- in this case, for the right of small business to use temporary sings on the property they lease or own, I was inspiried to write the following resolution. She took this and presented it to the Board of Brevard County Commissioners on the morning of January 25th, 2011. Durring her presentation, Commissioner Chuck Nelson made a motion to waive the permitting fees and daily useage fees for temporary signs until December 31st, 2011. Mary Bolin seconded that motion, and it carried by a UNANIMIOUS vote!! We have now been invited by the Commission to work with county staff to completely rewrite Brevards County's sign ordinance. We will do so with the purpose of placing the CONSTITUTIONAL RIGHTS of property owners above the governments intrest in regulation. I am requesting you distribute this to the local 9-12 group so they learn the fight can be won. I am including the resolution in hopes that you can share it with other Tea Party groups and that someone else can use it to help their community. A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BREVARD COUNTY, FLORIDA, ADOPTING AN EMERGENCY, TEMPORARY WAIVER OF PERMITTING FEES FOR TEMPORARY BUSINESS SIGNS; PROVIDING FOR THE LOCATION AND TIMES OF USAGE OF SAID SIGNS; DEFINING AND LIMITING THE NUMBER OF SAID SIGNS; AND PROVIDING FOR AN EFFECTIVE DATE AND A REVIEW/SUNSET DATE FOR THIS TEMPORARY WAIVER.

WHEREAS, with the unemployment rate within Brevard County , Florida being 12.6% -- 3.5% above the national rate of 9.1% (as of November, 2010- U.S. Bureau of Labor Statistics, updated January 12, 2011) and with Brevard County having 8,844 foreclosure homes with 1 in every 489 housing units having received a foreclosure filing in December of 2010 (RealtyTrac, as of  January 21, 2011) the Board of County Commissioners of Brevard County, Florida  recognizes the impact a weakened economy has had on the residents of, and the businesses located within, Brevard County; and

            WHEREAS, the pending layoffs in the space industry will have a further negative impact on the local economy; and

WHEREAS, the Board of County Commissioners of Brevard County, Florida finds that it is in the best interest of the county government, the citizens of, and the businesses located within Brevard County to implement policies to improve the local economy by encouraging local citizens and visiting tourist to spend their purchasing dollars with local merchants who will in turn increase employment, maintain the property tax base, and provide increased sales tax revenues; and

WHEREAS, it is the desire of the Board of County Commissioners to temporarily relax the Brevard County Ordinance relating to the use of portable and temporary business signs and waive the permitting fees for said signs in order for local businesses to more readily identify and promote the goods and services available to local citizens and visitors for purchase.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Brevard County, Florida as follows:

SECTION 1.  Adoption of policy relaxing the use of temporary signs.

The Board of County Commissioners hereby adopts a Policy --for a period of one (1) year-- establishing a waiver of the permitting fees for, and relaxing the use of temporary business signs, as set forth herein. This Resolution applies to the unincorporated areas of Brevard County.

SECTION 2.  Definitions.

The words and language used within this Resolution shall have the same meaning and definitions as used within the Brevard County Code (BCC) of Ordinances; Part II, Chapter 62- Land Development Regulations, Article IX, Signs, unless otherwise stated herein. By their design, portable signs are intended for temporary use and are therefore included within the meaning of “temporary” as used herein.

          SECTION 3. Use of portable and temporary signs.

A.    In addition to any permitted “On-Premise” sign:

1. The property owner/landlord of each business center/location with more than three units (leased or empty) is allowed one marquee type “portable sign” for rotating use by their tenants. In shopping centers or strip malls with more than eight units, one of the above “portable signs” shall be permitted for every multiple of eight units. Said signs may be parked on any roadside easement or area that the property owner is responsible for maintaining and pays property taxes on, in any designated parking area, or other area within the property /business owner’s custody and control. These signs shall not block any sidewalk, pedestrian traffic areas or driveways and should comply with sections 62-3311, 62-3312 and 62-3313, BCC. These (subsection 3. A. 1.) “portable signs” may remain in place 24 hours a day. It is suggested – but not mandatory, that these portable type signs be relocated as the tenant’s use of the sign changes.

2. In addition to the above, each business owner shall be allowed the use of two “temporary” signs.   These temporary signs may be “feather” type (sturdy cloth or other material with graphics, with one or both sides attached to a pole, and firmly anchored) or “sandwich” board (A-frame) type signs. Two of one type or one of each type may be used. Similar, conforming styles of signs may be interchanged. The “maximum aggregate sign surface area” for these signs combined shall not exceed 200 square feet, as stated within section 62-3317, BCC. These signs may be placed on any roadside easement or area that the property owner is responsible for maintaining and pays property taxes on, or on any designated sidewalk or parking area within the property/business owner’s custody and control. These signs shall be placed so as to not block pedestrian traffic or driveways, and should comply with sections 62-3311, 62-3312 and 62-3313, BCC. These (subsection 3. A. 2.) temporary signs shall only be displayed during the businesses hours of operation and shall be removed and stored when the business is closed.

3. If a property owner/landlord does not provide a “portable sign” (3.A.1. above), a business owner/tenant—with the property owners/landlords permission, may use one “portable sign” and one other “temporary” sign as described in subsection 2 above. The limits on aggregate surface area and sign placement will apply as stated within 1 and 2 above.

B.  Permit required. An “Application for Temporary Sign Permit” shall be required:

      1. For each property owner/landlord intending to provide a “portable sign” for each business property. However, only one application per property shall be necessary regardless of the number of signs to be used.

     2. For each business owner intending to use temporary signs, only one application shall be required for all temporary signs intended to be used by each business.     

     3. The “end date” for each sign permit issued after the effective date of this Resolution shall be the “sunset” date set forth within this Resolution.

     4. A copy of this Resolution and a current copy of Chapter 62, Article IX, BCC -- Relating to Signs, shall be distributed with each request for an “Application for Temporary Sign Permit”. Online requests shall conspicuously show the links to this information. Permits shall be issued without administrative obstruction or delay.

     5. A “Schedule of Fees”  for all permitting, usage, and for any and all other fees or charges imposed for whatever reason relating to signs, shall be compiled and distributed with all applications for any type of sign permit. Said schedule will be codified as section 62-3320 of the Brevard County Code of Ordinances and updated as necessary.

C. “Sign spinner’s” ( natural persons employed to hold or ‘spin’  signs, usually   stationed at a roadside)  are exempt from permitting under Chapter 62, Article IX, BCC, because they can reasonably be construed as engaging in their Constitutionally protected right’s of “Free Speech” and the right to “Peaceably Assemble”. Sign spinners shall not count within the total number of signs or maximum square footage of signs allowed.

           SECTION 4.  Temporary Wavier of Fees.

As stated within Part II, Brevard County Code of Ordinances, Chapter 2-Administration, Article V-Finance, section 2-132; “The Board of County Commissioners shall have the power to prepare and adopt by resolution a schedule of fees and charges…for providing…, permits, …and signs,…as may be necessary and proper.” Thus, having found the need for emergency temporary economic relief for local businesses, this Board of County Commissioners deems it necessary and proper to waive by this Resolution all fees and charges for the permitting and use of temporary business signs within the unincorporated areas of Brevard County. This waiver of permitting and usages fees shall extend for a period of one year from the date of passage of this resolution.

          SECTION  5.  Review/ Sunset.

The County Managers office shall provide a report on the number of permits issued under this Resolution at a time of six (6) months into this program and again at thirty (30) days prior to its scheduled expiration. A review of this program shall be made upon the presentation of the County Managers final report. The provisions within this Resolution shall sunset and expire one (1) year after the enactment date unless extended.

          SECTION  6.  Effective Date .

This resolution shall take effect immediately upon the date of execution.

Subject:  2011 Local Elections - January 25, 2011

One of the topics that was brought up at a recent “Brevard 912” group meeting was that, although 2011 is not only an “off-year” for elections, it is an “off-off-year” in that there are no state or federal offices in contention.  This notwithstanding, there are a number of local mayoral and council races that will be decided this November, and, since those elected will have just as much to say in deciding how we are taxed and how our money is spent as those elected in the “on-years”, we ignore these races at our peril.  The purpose in alerting us (conservatives) to this is to encourage us to get involved and run for these seats – some currently held by Dems & RINOs, who, since they love to spend other peoples’ money frivolously, should be vulnerable to challenge by anyone who can convince the voters that he/she would be a more responsible fiduciary.  For any who might be interested in running but feel they may not have the expertise or know-how to mount a campaign, there are several talented and experienced campaigners who have expressed their willingness to help.

Here's a chart that I pinched from the Brevard 912 website that shows some of the seats to be decided.  Since we’re still very early in the cycle, there will probably be additions before the bell rings, but this is how it currently stands.  This was not my work - I believe we have Ben Campione and Rob Feltner to thank for doing the homework & compiling the list (as well as for inspiring me to write this note).

Additionally, here's the list from the Brevard Co Supv of Elections, which adds Satellite Beach (2 city council seats) as well as the Barefoot Bay and Holiday Park Trustees:

In addition to the above elected offices there are a plethora of appointed panels, boards and commissions dealing with everything from "beautification" to police/fire pensions, zoning, code enforcement, youth sports, you name it, that get to decide how tax dollars are spent (and wasted).  It would be great to have some conservative voices on these boards.  One of my favorites that should never exist is the "Community Redevelopment Agency" that seeks to game the grant system and further obfuscate the purpose for which taxes are collected by collecting them in one area to be spent capriciously in another on things that the taxpayer never imagined his hard earned $$$ would ever be used for (business signs, façade improvements, etc).  But I digress…

For additional info, I recommend attending the local (usually monthly) meetings of the following conservative groups:  Brevard 912, Republican Liberty Caucus, Ronald Reagan Clubs, Titusville Patriots, Space Coast Patriots, Republican Men’s Club (& Women’s), Brevard Republican Executive Committee (must be a registered Republican), Citizens for Constitutional Property Rights, Florida F.A.C.E. OFF, and any others that I owe an apology to for leaving off this list, as you will hear and meet many fine folks who are a lot better informed on this stuff than I.  As well as being informative, these meetings are frequented by some of our elected officials, affording you the opportunity to present your concerns (and criticisms) in a much less formal setting than, say, an official council or commission meeting.  Please “Google up” the websites of the above groups for meeting details – you’ll be glad you did.

In the Federal Government and mostly in those institutions that are classified as “Law Enforcement” agencies, most of the agents, like Border Patrol, former INS, Customs, etc…. are unionized.

And, I can assure you that many of them are Conservative and Ultra Conservative.  They participate in Unions because without them inside, their ideas and votes wouldn’t be counted; it’s a necessary evil.

Unions would run lose if the Conservatives weren’t inside, they don’t ID themselves as such in front of their leaders (many are also Conservative).  You can disagree with me but I can prove what I say…

I awaken to your radio program most days of the week. You have captured my interest, and respect.

Your suggestion regarding contacting you and your radio station by E-mail raised my curiosity. So I brought your site up and searched for a picture to match the voice.

Knowing your police background, if you were in a police lineup. I would pick you out as a police detective rather than a radio show host. (OFFICER BILL)

Now getting to the point of my E-mail. My wife and I relocated to this area early in 2006 from Boca Raton FL. Coming from that area and working a sales route from Tittusvilleto Key West before I was forced to retire on SS disability, I have seen my share of panhandlers more so in the warmer area of the South.

However only this area is the only place I have seen young woman with signs saying they were hungry please help! The first one I saw was a young woman on New Haven just west of Minton.. On that occasion I was by myself and as I passed her I had to stop for the light. The thought passed through my mind that I should turn into the Lowes parking lot and instruct her to go over to the 711 across Minton and I would buy her something to eat. Bill I'm 65 years old and I had a sudden burst of fear about the whole thing and continued home.

Then on Thursday my wife was with me, and we were heading south on Whickam north of New Haven. Again I had to stop for the same light when I noticed a young blonde girl standing out in the cold with a very pink  looking cold nose and flip flops.( with hungry help sign )

My heart sunk and I reached for my wallet and all I had was a $20.00 bill. My first thought was NO its to much. Then my own two daughters flashed through my head. I handed the twenty to my wife who in turn got the young girls attention and gave it to her. We were pleased the girl said we did not have to that indicating it was to much money.

One thing that sticks in my mind was she turned back to traffic with sign in hand.

I would have headed for something to eat myself. Again fear for myself and my wife struck if I turned in to give aid would their be someone waiting in the wings to hold us up, maybe steal my car?

The economy today has some awful effects.

I have always tried to help somebody in distress, always thinking of my own girls and hoping someone would help them if needed. ( not that they would need it because we taught them well) There just is too many sick people out their.What are your thoughts on the subject; should we stop and help or not?

Thank you for your topic this morning in regards to the political strife occuring in Cape Coral.  Dave Montrose and his wife Jessica met my friend and I a few months ago.  Long story short....we are being besieged by not just Bill Deile but 4 other of his political support group members who were either elected or appointed.  They call themselves, The Road Ahead Gang. Seriously.  Shortened, RAGS. The RAGS met together to organize and get themselves elected in our town.  Voter Apathy abounded and they were elected.  To learn more, just google Cronyism in Cape Coral.  WE have started actually, that runs separate from Dave's wonderful blog, a face book page, "Get out and Vote...Take Back the Cape'  www.facebook.com/takebackthecape    Our hope is to end voter apathy through education, motivation and encouragment.  With fuel such as Mr. Deile's attacks on Dave, they are hopefully making our job easier. 

I wanted to also share, that several years back, I was a Charter School Governing Authority Board Member.  I resigned half way through my term. There was a lot going on that made me just absolutely NUTS.....and my Doctor shared that I should cut back on stressful activities for health reasons. Dave's a decent fella.    He helped us when we hosted a town hall meeting in a public library to have a planning meeting for the Get out And Vote...Take Back the Cape effort.  Mr. Deile was there, and was outside the library telling people entering the library that we had thrown out a videographer. The Videographer, a friend/cohort of the RAGS, came unannounced to video tape our session. We asked him not too. We didn't want them to use the tape against City Employees who had come to share and participate, and to also help protect Dave. WeI didn't throw anyone out of our public meeting. I asked to take the equipment down until we asked all the attendees, a capacity filled room of over 150 people.  Close to 200.  When my husband approached Mr. Deile and told him that he was not telling the truth, Mr. Deile threatened to SUE my husband and I, and my friend who actually started the Facebook page.  We feel like we are David fighting Goliath here, and we shouldn't have to worry or fear our government. We live in America, not in 1960s Russia or 1930s Germany!

He is the 'spokesperson' for the council it seems.  Also, not sure you will be able to get Dave to speak, and I know you don't know me, but Dave's a great guy or I wouldn't be supporting him.

Wow what entertainment, I thought they would at least make it out of the month of January before they started the back biting and infighting.  You would think they could have each other’s handlers talk to each other and present some kind of a united front rather than showing the media and public their obvious schism.  I think this comes down to reality being on Mike’s side.  See it’s easy to run for governor and talk about tax cuts without telling anyone how you are going to pay for it, and then when you get into office, you just blame the legislature for roadblocking your agenda.  At least it’s not as bad as in Washington where the republicans can want tax cuts and not have to pay for them but we have to have a balanced budget and now you get down to nut cutting time and guess what, most of your constituents want what most of your listeners call “big government”.  This is where the rubber hits the road. 

BTW just following up on your conversation with Matt Reed on tort reform and making the losing party pay atty fees, we are seeing in the mortgage foreclosure arena that the homeowners who are in default will hire an attorney to stave off the inevitable, and the bank does nominally recover attorneys fees in the judgment of foreclosure, however, the homeowner is playing with house money (no pun intended) because the bank will never collect on the judgment anyways.  So it’s no leverage.  I’m not saying don’t do it, I’m just saying it probably won’t deliver the desired results.

About a year and a half ago, I got called for jury duty.
They tried to seat me on two different juries.

BOTH were for medical malpractice cases.

As someone who has biomedical device design/manufacturing
experience, of course, the
lawyers didn't want me on the jury.

Oh, by the way, the first question asked by the lawyers was,
"Do you listen to talk radio?"

When I took a law class in college the lawyer instructor said "They don't put a person on trial unless they have a strong case."

The judge has control of the case and how jurors react to questions. If he starts out by telling the jury pool that they must be honest or it is perjury. I always objected to personal questions like "Have you or anyone in your family used drugs?" My college professor told me that I will never be selected because I have a crew cut, walk and stand straight and was military.

Also was warned not to ignore a summons or be fined. How much did it cost.

I missed my date for jury duty in the past.

What I did, was to show up for jury duty as soon as I became aware of my mistake. The clerk at the desk barked at me for missing the date and took my summons.

A few weeks later I received a new date for jury duty.

Period.   The media has interviewed people who said that he spoke of “mind control” and “voices.”   I cannot believe how the Libs are turning this into something else.  Hillary Clinton is overseas calling it the work of “an extremist” much like Al Qaeda.    Unbelievable.

2.      Not sure you ever read the Help column in Florida Today.  It’s a column where people write in and ask about how to find a certain type of business or how to fix something or whatever.  Well, someone wrote in about the stupid CFC light bulbs that we are forced to use.  The response was that “yes, these light bulbs will harm the environment.” The person was told to contact Waste Management for special foiled lined envelopes.  Then when the envelope is full, Waste Management will pick up the envelope.  What???  This is crazy.  Weren’t these stupid light bulbs foisted on us by the left wingnuts?

3.      Was very surprised by Aaron Lyons’ comments this morning.  I didn’t know that he was such a pessimist with regard to our Government.  Like you, I believe that our grassroots movements have had an impact and we just need to see some changes in Congress’ actions to be sure it’s working.

I don't think our U.S. realizes what a big deal Florida did by voting in Rick Scott.  He isn't in political debt to anyone.  We got rid of the "good old boys".  Of course we will be watching, but I think he will keep his word.  He will be business friendly.  He is checking the schools and the Florida employees.  We are lucky to have him.  My local newspaper slamed him even before he took office.

I think everyone is missing the point, this guy was just a nut case and like his friend said on tv, it has nothing to do with politics as much as the fact that a couple of years ago, he asked this congresswoman a question and she blew him off and ignored him… never answered and he never got over being ignored and I think before it’s all said and done, he will end up being diagnosed with schizophrenia ….   Just reading some of his posts and him believing that the govt has some sort of mind altering and controlling thought process…  people with schizophrenia, their minds are all scrambled up and they have a heightened sense of  paranoia and believe there are devices and things out there that control their minds…  but that is just my thought…  and you know if maybe more people carried guns openly and someone had one there and shot him in the beginning of his shooting, not as many people would have been killed and hurt…  of course I’m still trying to figure out why they have only charged him with 5 murders and 1 attempted murder????  How stupid is that of our government…  isn’t there 6 dead and 12 shot???  Looks like he should have been charged with 6 murders and 12 attempted murders….  But then again I gave up long ago trying to understand how our government works and their mind process!!!

Ok there is my take on it…   personally I like carrying a sidearm, people are less likely to screw with you…. And when I’m around people I don’t know, I always “rest” my hand on top of my gun….   J   (just in case you never know)

People who want gun control and scream guns kill…. Just how stupid are they???  A gun is an object…. PEOPLE kill people!!!!   What about all the knives used in murders, I don’t hear anyone screaming to ban them OR any of the other weapons used…. Baseball bats, tire iron, various kinds of poison, people’s own hands!!  I mean come on, people need to think rational….  I know guns can be a scary thing… however people are scarier!!!!

In Europe when the people are upset with the government they demand another election.
